What’s New With OSHA?
OSHA has rules and regulations to help keep each and every worker safe each day in the United States. Staying compliant with existing OSHA laws is a crucial part of maintaining a safe workforce. It can be a challenge to follow and keep up with new rules and changes to existing ones.
Below, we’ll highlight the top five OSHA updates that affect the majority of industries. While this isn’t a complete list of every regulatory change, it provides a strong foundation for safety planning in the year ahead.

OSHA Penalty Amounts Continue to Increase
OSHA adjusts penalty amounts every year to account for inflation, as required by the Federal Civil Penalties Inflation Adjustment Act. This helps to ensure fines remain strong enough to encourage workplace safety compliance.

Bigger Penalty Discounts for Small Employers
There’s good news for small businesses! OSHA has increased penalty discounts for employers with up to 25 employees, who may now qualify for up to a 70% reduction in penalties. In addition, employers who correct hazards immediately may be eligible for an additional 15% reduction. Prompt action not only protects workers, it can also significantly reduce financial impact.

Heat Illness Prevention Rule on the Horizon
A federal heat illness prevention rule is expected to become a final rule in the future. OSHA has already established a National Emphasis Program, which means they are actively inspecting businesses in high-hazard industries. If your employees work in high-heat environments, indoors or outdoors, now is the time to prepare. Employers should assess heat risks, provide access to water, rest breaks, and shade, and ensure that employees receive proper training on heat-related hazards.

Personal Protective Equipment (PPE) Must Actually Fit
Poorly fitting Personal Protective Equipment (PPE) can be just as dangerous as not wearing it at all. This update helps ensure all workers receive the protection they need. This applies to all construction workers, regardless of body type.

Changes to OSHA’s Walkaround Rule
OSHA has updated its walkaround rule, giving employers more flexibility during inspections. Companies may now choose either an employee or a non-employee to accompany OSHA during the walkthrough portion of an inspection.
